If, due to a lack of housing (or a domestic violence situation) you must live in a shelter, motel, vehicle or campground, on the street, in an abandoned building or trailer, or doubled-up with relatives or friends, then according to the McKinney-Vento Act, you are considered homeless.
Your School Age Child's Educational Rights
- A child who is 5 years old on or before Sept. 30th needs to go to kindergarten.
- Your child has a right to a free public education.
- Your school age child has a right to receive transportation to school just like the other students.
- Your child can begin school even if he/she does not have a birth certificate, immunization or school records, or a physical exam.
- Your child can go to the school he/she last went to, or to the school in the new area where you are living.
- Your child can receive the same special programs and services that the other children receive.
McKinney-Vento Homeless Assistance Act
McKinney-Vento is the primary piece of federal legislation dealing with the education of children and youth experiencing homelessness in U.S. public schools. It was reauthorized as Title X, Part C, of the No Child Left Behind Act in January 2002.
